Qualifications

Applicants for the office of notary public must meet the following criteria:

  • Must be at least eighteen (18) years of age
  • Must have resided in the State of Mississippi and the county of residence for at least thirty (30) days
  • Be a citizen or legal resident of the United States
  • Must be able to read and write English
  • Must not be a convicted felon

Term of Office
4 years
State law mandates that every Notary Public holding commission through an appointment of the Governor, must affix a written or printed recital of his/her commission's expiration date to any certificate of acknowledgment by him. Once a notary's commission has expired or been terminated, he or she is no longer a notary and he or she cannot continue to notarize documents. Acting under an expired commission may constitute a criminal offense.

Application Procedures

Step 1: Download and complete the Mississippi Notary Public Application

Mississippi Notary Public Application

You will need to complete the application, and then submit both the application and a $25.00 statutory fee to the Mississippi Secretary of State at the following address.

If the application is complete and accompanied by the fee, the Secretary of State transmits it to the Governor. If the Governor approves the application, a pre-Commission Certificate is mailed to the applicant. The applicant is not a notary at this point.

Renewing Notary Packages do not come with a notary journal

Our New and Renewal Notary Packages DO NOT include your required $5,000 Mississippi Notary Bond. The State of Mississippi requires purchasing your notary bond, which you will need to send along with your notary application.

Step 2: After receiving the Pre-Commission Certificate, order your $5,000 Surety Bond.

After receiving the pre-commission certificate, the applicant must obtain the proper $5,000 Mississippi notary bond and oath form. The bond should not be obtained prior to receiving the pre-commission certificate.

Please visit the Notary Rotary online store, and enter the store to purchase your official Mississippi surety bond. To order, enter the required information, scroll down through the page to locate and select the desired products, and follow the instructions through checkout. Once you receive your official surety bond from Notary Rotary, Inc. make a copy of the actual bond for your records.

The applicant should make certain he or she has signed the bond as principal, and signed the oath in the presence of a commissioned Mississippi notary. Once the bond and oath forms are complete, mail the application, surety bond and oath form back to the Mississippi Secretary of State's Office.

The law requires that the Insurance Commissioner and the Governor approve the surety bond before a commission can be issued. Once both officials have approved the bond, the Secretary of State's Office will mail the applicant his or her original Commission Certificate.

Step 3: Order your Official Seal and other supplies from The Notary's Store.

Once you have received your Commission Certificate and have all the information necessary, you can purchase your required notarial seal and notary journal, if you have not already purchased them. Please visit The Notary's Store you will be entering the Mississippi section for your official notary supplies. Your required Mississippi Notary Seal/Stamp and Mississippi Notary Journal are available for purchase. To order, enter the required information and scroll down through the page to locate the Mississippi notary seal/stamp and Mississippi notary journal and any other products you desire, and follow the instructions through checkout. Once you have your official seal and journal you are ready to perform notarial acts.

Note: An Errors and Omissions Insurance Policy is not required by law, but may be purchased as it protects the notary public and pays for any charges the notary might owe for legal fees and costs should the notary be sued.
