How the Notary and Notary Signing Agent Work Together
The Notary Signing Agent has the qualifications to both notarize
and present loan documents.
There are really two jobs
First the Notary Public confirms the identity of the borrower, witnesses the signing,
insures that the documents are signed correctly, administers oaths (if applicable) then
notarizes the required documents.
Second, the Signing Agent presents documents to the borrower and points out the important
areas of the loan; the Note, Deed of Trust, Truth in Lending, Impound Account (optional),
Right to Cancel, and the Estimated Closing Statement.
As a "Certified Notary Signing Agent", the Notary Public will have the knowledge
and skills to expand their job function to both aspects of the document signing process.
The Notary Signing Agent should always let the borrower know that they are an
"independent contractor" and not a part of the signing service, lender, title
or escrow company. A Notary Signing Agent cannot give legal advice.
