Qualifications

Applicants for the office of notary public must meet the following criteria:

  • Be at least eighteen years of age
  • Be a citizen or permanent legal resident of the United States
  • Be able to read and write English
  • Be a resident of or have a place of employment or practice in this state or must reside in a county that borders this state and which is in a state that extends reciprocity to a notary public who resides in a border county of this state.

Application Procedures

New and Renewing Notary Packages
New and Renewing Notary Packages
Renewing Notary Packages do not come with a notary journal

Our New and Renewal Notary Packages DO NOT include your required $7,500 North Dakota Notary Bond. The State of North Dakota requires purchasing your notary bond, which you will need to send along with your notary application.

Step 1: Order the required $7,500.00 surety bond from Notary Rotary, Inc.

Enter the store to view the selection of products available for North Dakota notaries. Follow the onscreen instructions and your order will ship as soon as we are able to process it, most items ship the same day they are ordered. When you receive your surety bond make a copy for your records, as the original will be sent with the application.

Note: An Errors and Omissions Insurance Policy does not replace a bond, but will help to repay the bonding company if a claim is ever made. Errors and Omissions is not required by law, but may be purchased as it protects the notary public and pays for any charges the notary might owe for legal fees and costs should the notary be sued.

Step 2: Download and complete the North Dakota Notary Public Application

Complete the application according to the instructions provided. You will need to contact a commissioned notary public to complete the affidavit of qualifications and oath of office. Make arrangements to have a notary public take your acknowledgment under oath or affirmation that the information provided in the application is true. The completed application, your surety bond and a $36.00 filing fee made payable to the "Secretary of State" should be sent to the following address:

Note: If the applicant resides in a county that borders North Dakota and which is in a state that extends reciprocity to a notary public who resides in a border county of North Dakota, an Appointment of Agent (SFN 19369) is required.

After the receipt of the fee, application and surety bond, you will be issued an authorization letter which authorizes a vendor to provide you with an official notary seal/stamp.

Step 3: Order your Official Seal from The Notary's Store

The State of North Dakota requires all notaries public to purchase a North Dakota notary seal/stamp to authenticate their notarial acts. Please revisit The Notary's Store you will be entering the North Dakota section for your official notary seal/stamp. If you haven't already purchased your required North Dakota notary seal stamp you can do so now. To order, enter the required information and scroll down through the page to locate the notary seal stamp and then follow the instructions through checkout. Once you have your official notary seal/stamp you may proceed with step 4.

You will need to mail the original certificate of authorization letter you received from the state to us before we may legally make your official seal or stamp. Certificates should be mailed to:

Step 4: File your official seal impression with the Secretary of State's office

Once you receive your official seal/stamp, an impression of the seal/stamp must be affixed to the Certificate of Authorization and returned to the Secretary of State's office. After the certificate is received, approved and filed, the Secretary of State will issue an official notary commission. Under no circumstances may an applicant commence with the duties of the notary public until such time their official commission has been issued by the Secretary of State.
