Applicants for the office of notary public must meet the following criteria:

  • Be 18 years of age or older
  • The Secretary of State may not appoint, as a notary public, any individual who has been convicted of a felony.
  • Any applicant for the position of South Dakota notary public must be a South Dakota resident able to include a South Dakota address on the application.

Application Procedures

New and Renewing Notary Packages

Renewing Notary Packages do not come with a notary journal

Our New and Renewal Notary Packages DO NOT include your required $5,000 South Dakota Notary Bond. The State of South Dakota requires purchasing your notary bond, which you will need to send along with your notary application.

Step 1: Order your Official Notary Supplies from The Notary's Store but you will need to order your notary bond separately.

Applicants for the office of notary public for the State of South Dakota must acquire a $5,000 surety bond and application.

Applicants for the office of notary public for the State of South Dakota must acquire a $5,000 surety bond, or arrange a personal surety, and an official seal as part of the application process. Please visit The Notary's Store you will be entering the South Dakota section for your official notary supplies. We offer a New Notary Supply Package and a Renewing Notary Supply Package which include your required South Dakota Notary Seal/Stamp,South Dakota Notary Journal and other needed notary supplies at a special reduced price, but you will need to order your required $5,000 South Dakota Notary Bond separately. South Dakota law does not require a notary to keep a record of his/her official acts, but it is recommended to do so. A record book will offer an excellent way of recalling past notarial acts. If a notary is called upon to testify in court, a record book may help establish what actually took place. The South Dakota Notary Journal, also available in the online store, was specifically designed for this purpose and contains many elements not available in other registers. To order, enter the required information and scroll down through the page to locate the notary packages, or you can purchase your notary supplies separately. Follow the instructions through checkout. Once you have your official bond you may proceed with step 2.

Step 2: Complete the South Dakota Notary Public Application

Complete the Notary Public Application, Oath and Bond and sign your portion of the surety bond form, making sure to include an impression of your seal in the appropriate place. When the application is complete send it and a filing fee in the amount of $30.00, made payable to "Secretary of State", to the following address:

If your application is approved, the office of the Secretary of State will send your notary commission certificate and a copy of the South Dakota notary public handbook to you at the address listed in the application. Only after you have received a Notary Commission Certificate issued by the Secretary of State, are you authorized to notarize documents.

Note: An Errors and Omissions Insurance Policy does not replace a bond, but will help to repay the bonding company if a claim is ever made. Errors and Omissions is not required by law, but may be purchased as it protects the notary public and pays for any charges the notary might owe for legal fees and costs should the notary be sued.
